Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

on which you or a third party named by you, other than the carrier, takes possession of the goods, if you ordered one or more goods as part of a single order and they are delivered uniformly;
on which you or a third party named by you, other than the carrier, takes possession of the last good, if you ordered multiple goods as part of a single order and they are delivered separately;

To exercise your right of withdrawal, you must inform us (Marianne Birkenfeld, Marktplatz 8, 27711 Osterholz-Scharmbeck, Tel.: 04791 9859158, Email: reklamation@posseimo.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email). You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without undue delay and in any event no later than 14 days from the day we receive notice of your withdrawal. We will use the same means of payment that you used for the original transaction unless you have expressly agreed otherwise; in no case will you incur any fees as a result of the refund.

We may withhold the refund until we have received the goods back or you have provided proof of having sent back the goods, whichever is earlier.

You must return the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods before the 14-day period has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.

Exclusions and Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts

for the supply of goods that are made to the consumer’s specifications or are clearly personalized;
for the supply of goods which are liable to deteriorate or expire rapidly;
for the supply of alcoholic beverages, the price of which was agreed at the time of contract conclusion, the delivery of which can only take place after 30 days, and whose actual value depends on fluctuations in the market over which the trader has no control;
for the supply of newspapers, periodicals or magazines with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts

for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items;
for the supply of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
